To the Hon. Court of Probate now holden at Lenox within and for said County. Asa Hall Jun. of Windsor in sd. County submits the following statement, viz. That Lyman Stone late of sd. Windsor, deceased, died July 19, [or 29?] 1818 testate appointing Simon Stone late of sd. Windsor the Executor of his will, who has since deceased. That the said Lyman, deceas’d had never been married. That he left Charlotte his mother and Orin Stone and Milo Stone [sic; Ira Stone] of lawful age, and Ward Stone above fourteen years of age and Philander Stone born Sept. 17, 1807, his brothers, and Almira born Jan.y 10, 1811 and Malinda born may, 1801 his Sisters all residing in Windsor aforesd his only heirs at Law. who having signified their wish not to take administration on the estate of the aforesaid Lyman deceas’d The afores’d Asa Hall Jun. being his uncle therefore prays that he may be appointed Administrator with the will annexed on his estate. P. 423 -------------------------------Will, Probate Etc. / 2 February 1819----------------------------------- COMMONWEALTH OF MASSACHUSETTS. BERKSHIRE ss. BY the Honorable WILLIAM WALKER, Esquire, Judge of the Probate of Wills, &c. within and for the said County of Berkshire, To all unto whom these presents shall come, GREETING. KNOW YE, That at a Court of Probate, begun and holden at Lenox within and for the County of Berkshire, on the Second day of Febuary [sic] in the year of our Lord eighteen hundred and nineteen before me the said Judge. THE Instrument hereunto annexed, is presented as the last Will and Testament of Lyman Stone late of Windsor in the County of Berkshire deceased, by Asa Hall Jun’r. of s’d Windsor for Probate, the Executor therein named, being dead. And Robert Walker, Gideon Parsons and Asa Hall Jun’r. the subscribing witnesses to the same, appearing, made oath that they saw Lyman Stone the testator sign and seal, and heard him publish and declare the same to be his last Will and Testament; that he appeared to be of lawful age, sane mind, and disposing memory when he did it; and that they all subscribed as witnesses to the same, at the same time, in the presence of the said testator I DO THEREFORE, by virtue of the power and authority to me given in and by the laws of the Commonwealth aforesaid, decree that the same Will is proved; and do approve and allow of the said Instrument, as the last Will and Testament of the said Lyman Stone deceased. And I do commit the execution thereof, in all matters concerning the same, and of the estate of the said Lyman Stone whereof he died seized and possessed in said County, unto Asa Hall Jun’r as administrator with the will annexed. well and faithfully to execute the same, and to administer the estate of the said deceased according thereto, who accepts of the said trust and gives bond as the law directs, to render a full and perfect inventory of said estate, into the Probate Office of said County, upon oath, within three months: and also to render a just and true account of his proceedings thereon, upon oath, within one year from the date hereof. P. 423 --------------------------Administration with Will; Bond / 2 February 1819------------------------ KNOW all Men by these Presents, That we Asa Hall Junr as principal of Windsor and William Prince of s’d Windsor and Samuel Wright of Hinsdale as Sureties— in the County of Berkshire, within the Commonwealth of Massachusetts, are holden and stand firmly bound and obliged unto the Hon. WILLIAM WALKER, ESQUIRE, Judge of Probate of Wills, and granting Administrations within the County of Berkshire, in the full sum of Five Thousand Dollars, to be paid unto the said Judge, or his successors in the said office, or assigns; to the true payment whereof we do bind ourselves, and each of us, our, and each of our Heirs, Executors, and Administrators, jointly and severally, for the whole, and in the whole, firmly by these presents. Sealed with our seals. Dated the second day of Febuary [sic], in the year of our LORD eighteen hundred and nineteen. The Condition of this present Obligation is such, that if the above bounden Asa Hall Junr. who has this day taken upon him the office of Administrator with the will annexed of the estate of Lyman Stone late of Windsor aforesaid deceased, shall return upon oath, a true and perfect Inventory of all and singular the Real Estate Goods and Chattels, Rights and Credits of the said Testator[?] which have or shall come to the knowledge and possession of him the said Administrator or into the hands and possession of any other person or persons for him into the Probate Office, in the said County of Berkshire, upon or before the second day of May next ensuing. And further do make a just and true Account of his Administration on oath, as aforesaid, at or before the second day of Febuary [sic] which will be in the year of our LORD, one thousand eight hundred and twenty and all the rest and residue of said Goods, Chattels, Rights and Credits shall deliver and pay unto such person or persons as the said Judge or Judges, by his or their decree, order or sentence, pursuant to Law, or said Will, as the case may be, shall limit or appoint; Then this Obligation to be void, otherwise to remain in full force. BERKSHIRE ss. TO Thomas Allen Esq. of Hinsdale and Gideon Parsons and Ephraim Baldwin of Windsor in said County, and disinterested Freeholders, GREETING. YOU are hereby appointed and impowered to make an Inventory of all the Estate whereof Lyman Stone late of Windsor in the County of Berkshire deceased, died seized and possessed in said County of Berkshire, and (according to your best skill and judgment) truly and justly to appraise the same, under oath, according to the present value thereof, in lawful money of this Commonwealth. And you are to make return of this Warrant, with your doings therein, into the Probate Office of the said County, within three months from the date hereof. Then said Gideon Parsons and Ephraim Baldwin came before me and severally made oath that they would faithfully and impartially perform the service within assigned them. Thomas Allen, Just. HUMBLY SHEWS Asa Hall Jun’r Administrator with the will annexed on the estate of Lyman Stone late of Windsor in the County of Berkshire deceased, THAT such are the Condition and Circumstances of the said deceased’s Estate, (the particulars of which he is ready to lay before your Honor) that he is apprehensive it will be insufficient to pay all the just Debts which the said deceased owed; he would therefore represent the said Estate as Insolvent, and pray that your Honor would nominate and appoint Commissioners to receive and examine the Claims of the several Creditors thereof, according to law. Hinsdale Gideon Parsons Windsor Liss No. allowed [?] -------------------------------Commission on Insolvency / 1 March 1819-------------------------- BERKSHIRE ss. To Thomas Allen Esq. of Hinsdale and Gideon Parsons of Windsor in said County GREETING. WHEREAS Asa Hall Jun Administrator with the will annexed on the estate of Lyman Stone late of Windsor in the County of Berkshire deceased, has represented to me WILLIAM WALKER, ESQUIRE, Judge of Probate of Wills, &c. for said County, that the said Estate is insolvent, and insufficient to pay all the just debts which the said deceased owed: I DO, therefore, hereby nominate and appoint you to be Commissioners, with full power to receive and examine all the Claims of the several Creditors to the said Estate, excepting those of the Administrator and Commissioners having first caused the times and places of your meeting, to attend them for that purpose, to be made known, by causing an Advertisement thereof to be inserted in the Pittsfield Sun printed at Pittsfield three weeks successively, ten days at least, before your first meeting. And six months are hereby allowed unto the said Creditors for bringing in and proving their claims; at the end of which time you are to make report, and present unto me, upon Oath, a list of all the claims that shall have been laid before you, with the sums you shall allow on each Claim, and upon what evidence they are claimed; distinguishing such claims as are for Taxes and Debts due to the Commonwealth, and expences of the last sickness of the said deceased, and such claims as shall not have been satisfactorily made out. Given under my Hand and Seal of Office, this second day of Febuary [sic], Anno Domini Eighteen Hundred and nineteen William Walker BERKSHIRE ss. March 1, 1819 THE above named Thomas Allen personally appeared, and made solemn oath, that he would faithfully discharge the trust reposed in him by the foregoing Commission. Before me, Thomas Thompson Just of the Peace [marginalia:] 1st Tuesday of April 1st Monday of Aug’t 10 till 5 – at Mr. S[tarnes?] [back:] Berkshire ss. March 2d. 1819. Then said Gideon Parsons came before me and made oath that he would faithfully discharge the trust reposed in him by the within instrument— Thomas Allen, Just. Peace Berkshire ss. Aug’t 2d. 1819. We the Commissioners within named being given this notice & severally taken the oath within required, have attended to the service herein required of us and have allowed to the several auditors of s’d Lyman, named in the list hereto annexed, the several same therein set against their respective names. No other claims against s’d estate were presented to us. At a Court of Probate, holden at Lenox within and for the County of Berkshire, on the second day of Febuary [sic] A. D. 1819. ORDERED, by the Court, that Asa Hall Jun. Administrator with the will annexed on the estate of Lyman Stone late of Windsor in said County deceased, testate, publish notifications of his appointment to, and acceptance of the trust aforesaid, by giving bond as the law directs; by posting up the same in some public places in Windsor foresaid, the last residence of the deceased; and also by publishing the same in the Pittsfield Sun Printed at Pittsfield three weeks successively, all within three months from his said appointment. Administrator with the will annexed on the estate [of] Lyman Stone late of Windsor in the county of Berkshire, deceased, testate, that the value of the real estate of said deceased as appraised in the Inventory thereof is one thousand eighty five dollars and fifty cents That the amount of the assets in the hands of the said Administrator as appears by his account this day rendered and allowed is two hundred and fifty three dollars and eleven cents. That the amount of the charges of the said Administrator, as allowed by the Court of Probate for expenses of settling the estate & funeral charges is forty four dollars and nine cents. That the amount allowed by the commissioners of insolvency on said estate as appears by their report is one hundred and seventy one dollars and thirty three cents. William Walker Judge of said Court A settlement of the personal Estate of Lyman Stone late of Windsor in said county deceased testate agreeably to his last will & testament as ordered by the said Judge The whole amount of the personal Estate a’frs’d [aforesaid] testate including his rights and credits as appears by the account of Asa Hall Junr said Administrator with the will annexed is six hundred thirty six dollars and eight cents $636.08. The whole amount of the account of the said Administrator against s’d Estate for the Expenses of settling the same & financial charges & payment of debts as appear by said Administrators account is five hundred eighty seven dollars & seventy cents $587.70. Which last mentioned sum being deducted leaves in the hands of the said Administrator a balance of forty eight dollars & thirty eight cents $48.38 It is thereupon ordered & decreed by the said Judge that the said balance be divided & paid to & among the legatees of said testator agreeably to the provisions of his will as follow viz—To Charlotte his mother his trunk appraised at four dollars – To Melinda his sister his watch appraised at seven dollars & to his six brothers & sisters viz—Orin-Ira-Ward-Melinda-Philander and Almira all his wearing apparel & other small articles in his father’s house at the time of his decease amounting per inventory to thirty seven dollars & thirty eight cents to be equally divided between them which will be to each the sum of six dollars & twenty three cents.
